Vietnam’s Communist Party built its legitimacy on robust economic growth, and it fears alienating foreign investors. It is unclear how far continuing unrest will harm the economy or affect back-channels with the Chinese government (Vietnam’s urgent request that China agree to receive a top-ranking envoy in Beijing over the oil rig appears to have been rebuffed). But a drawn-out dispute will not help political factions allied to the president, Truong Tan Sang, or to the party secretary-general, Nguyen Phu Trong, both reckoned to be generally pro-China. If anything, the row may be strengthening the hands of party reformers who chafe at the China-friendly status quo.

ベトナム共産党は堅調な経済成長の上にその正当性を築いており、海外投資家を遠ざけてしまうことを恐れている。継続する混乱がベトナム経済をどの程度損ねるのか、あるいは中国政府との裏ルートにどの程度影響を与えるのかは定かではない（中国が石油掘削機の件で北京で特命使節を受け入れることに合意することを望むベトナムの喫緊の要望は拒絶されたようである）。しかし、長引く係争は共に親中国であると見なされるチュオン・タン・サン国家主席の派閥あるいはグエン・フー・チョン共産党書記長の派閥のためになるものではない。それどころか、こうした騒動は中国と友好的な現状に苛立っている党改革派の力を強めていくことになりかねない。

AFTER nearly three years, Yingluck Shinawatra’s stint as prime minister of Thailand drew this week to its inevitable close. The end came not with the bang of a people-power revolution that at one point seemed likely to unseat her; nor with the muted rumble of tanks in a coup like the one that toppled her brother Thaksin from the same job in 2006; still less with the raucous clamour of a contested election, though one had been called for July 20th. Rather, it petered out in the whimper of a court order. Not for the first time the Thai judiciary has intervened to solve a problem that a broken political system could not fix. And not for the first time its intervention was to the Shinawatras’ detriment.

ほぼ3年が経った後、インラック・シナワトラのタイ首相としての任期は今週、避けがたい形での終結を迎えた。その終結は、一時彼女の座を剥奪するかに見えた人民の力による革命の激しい活動によるものではなく、2006年に同じ職から彼女の兄弟であるタクシンを打倒したのと同じ軍事無血クーデ ターでもない。さらに、7月20日に行われてはいるが、無効の申し立てのあった選挙への激しい抗議の声によ るものとも言い切れない。むしろ、その声は裁判所命令が発せられたことにより収束した。タイ司法が、破綻した政治システムが修復できない問題を解決するために介入するのは初めてではない。また、その介入がシナワトラ一族の不利益となるように為されたのも初めてではない。 

However, Thailand is not alone in fighting political battles with legal weapons. A number of Malaysian opposition politicians find themselves in legal trouble, with potentially serious consequences. In Myanmar the opposition is planning demonstrations this month to demand reform to a constitution that places legal obstacles in the way of the country’s democratisation, and of the right of Aung San Suu Kyi, the opposition leader, to stand in a presidential election she would surely win. Even in China a purge of potential opponents of Xi Jinping, the president and party leader, takes the form of a series of prosecutions for corruption. More hopefully, in Pakistan, Pervez Musharraf, a former army chief and military dictator, is fighting a charge of treason, in a trial testing the army’s willingness to cede privileges and immunity to an elected civilian government.

しかし、法的な力と政治的な戦いをしているのはタイだけではない。マレーシアの野党の政治家の多くは、深刻な結果となる可能性のある司法上の問題を抱えて いる。ミャンマーでは野党が今月、デモを予定していて、国の民主化への道と勝つことが確実な大統領選に立とうとしている野党党首のアウンサンスーチーの権利に対して法的な障害を置く憲法の改革を求めている。中国でも、国家主席で共産党書記長である習近平の潜在的な反対派の粛清が、汚職に対する一連の訴追という形で表れている。より望ましいのは、前・陸軍参謀長で軍事独裁者であったパルヴェーズ・ムシャラフが選挙で選ばれた民生政府に特権や免責の権利を軍が譲ろうとする意思があるかどうかを問う公判で、国家への反逆の告発に対して法廷闘争をしていることである。
